These General Terms and Conditions (AGB) govern the contractual relationship between Shiwali Kathpal, A.N. Immobilien (hereinafter "A.N. Immobilien") and clients who engage our property consulting services.
A.N. Immobilien provides property consulting and advisory services for individuals seeking to purchase residential real estate in Germany. Our services are described on our website at animmobilien.de and include: property scouting, price evaluation, due diligence, financing guidance, renovation assistance, and end-to-end support.
A.N. Immobilien does not act as a Makler (estate agent) in the legal sense under §652 BGB for third-party listings unless explicitly agreed otherwise in writing. Our services are advisory and consultancy-based.
A contract is formed when the client accepts a written service offer (via email or written agreement) from A.N. Immobilien, or when the client makes payment for a specified service.
Enquiries submitted via the contact form on animmobilien.de do not constitute a binding contract and carry no obligation for either party.
Current service fees are listed on the website at animmobilien.de. All prices are inclusive of applicable VAT unless stated otherwise.
Service fees are payable in advance unless otherwise agreed in writing. Payment is accepted by bank transfer (SEPA) or other methods agreed at the time of engagement.
Each service covers the scope described at the time of booking. Additional work beyond the agreed scope will be quoted and invoiced separately with prior written agreement.

Important: A.N. Immobilien provides property consulting advice based on publicly available information, documents provided by third parties, and our professional assessment. Our opinions and valuations are advisory in nature and do not constitute a certified valuation (Gutachten) as defined under German law.
A.N. Immobilien shall not be liable for:
Liability for gross negligence and intentional misconduct remains unaffected. Our professional liability insurance (Vermögensschadenhaftpflicht, minimum €500,000 per claim, via Exali AG) covers cases of verified professional error.
In all other cases, liability is limited to the fee paid for the specific service in question.
Clients who are consumers (Verbraucher) within the meaning of §13 BGB have the right to withdraw from the contract within 14 days of contract formation without giving reasons, in accordance with §312g BGB.
To exercise the right of withdrawal, the client must notify A.N. Immobilien clearly in writing (email to info@animmobilien.de) within the 14-day period.
Exceptions: The right of withdrawal expires before the 14-day period if the service has been fully performed and the client has expressly agreed to performance beginning before the withdrawal period ends, acknowledging the loss of the right of withdrawal upon full performance.
If the client cancels after work has begun but before completion, A.N. Immobilien is entitled to invoice for the proportion of work completed.
A.N. Immobilien treats all client information as strictly confidential. Client data, financial details, property preferences, and correspondence will not be shared with third parties without explicit consent, except where required by law.
Reports and analyses provided to clients are for their personal use only and may not be shared commercially or published without written permission from A.N. Immobilien.
The processing of personal data in connection with our services is governed by our Privacy Policy (Datenschutzerklärung), available at animmobilien.de/datenschutz.html. By engaging our services, the client acknowledges the privacy policy.
These terms are governed by the laws of the Federal Republic of Germany. The place of jurisdiction for all disputes arising from the contractual relationship, where legally permissible, is Berlin, Germany.
The European Commission provides an online dispute resolution platform: ec.europa.eu/consumers/odr/. We are not obligated to participate in alternative dispute resolution proceedings before a consumer arbitration board.
A.N. Immobilien reserves the right to update these terms. Clients will be notified of material changes by email. Continued use of our services after notification constitutes acceptance of the revised terms.
The version of these terms in effect at the time of contract formation governs that contract.
